2023 US Sentencing Amendment to 1B1.13 Ushers in a New Era

According to the 2013 USSC revisions to 1B1.13, courts now have the authority to grant the release of an inmate or lessen their sentence in light of novel “extraordinary and compelling reasons.” The existing criteria for medical incapacitation and the needs of spouses and children remain unchanged. However, these new categories are applicable to inmates residing in facilities impacted by disease outbreaks, inmates with parents or other relatives requiring caretakers, inmates who have experienced assault while in custody, and, in order to resolve a disparity among jurisdictions, inmates who have served more than 10 years of an “abnormally lengthy sentence” due to subsequent alterations in the law.
These sweeping reforms are incredibly broad and expand the opportunity for compassionate release to a wide range of circumstances.
